Standard Setting Organizations and Standard Essential Patents: Voting Power versus Market Power
نویسنده
چکیده
The key nding is that Standard Setting Organizations (SSOs) choose e¢ cient technology standards because voting power and market power have counterbalancing e¤ects. Agents on the long side of the market have less added value in the marketplace but more voting power in cooperative organizations and conversely for the short side of the market. In a two-stage model, industry members choose technology standards by voting and then compete in the marketplace. When there is disagreement among industry groups, without Standard Essential Patents (SEPs), SSO members vote for the e¢ cient standard unanimously. In an equilibrium with SEPs, inventors and technology adopters choose e¢ cient standards, although voting may not be unanimous. متن کاملAssessing the Link Between Standards and Patents
Some policymakers, courts, and academics have expressed concerns that when a firm’s patents are incorporated into a standard, the patents gain importance and can bestow on the patent holder market power that can be abused when the standard is commercialized. This paper extends the existing literature on the effect that standards can have on patents. This analysis has two aims: first, to better ...

• Standards reduce production costs and increase products’ value to consumers. Standards however entail risks of anti-competitive abuse. After the adoption of a standard, the chosen technology normally lacks credible substitutes. The owner of the patented technology might thus have additional market power relative to locked-in licensees, and might exploit this power to charge higher access rate...
متن کاملThe Interplay of Patents and Standards for Information and Communication Technologies
ICT products are often interdependent and in some cases indispensably work together. Firms may thus compete on different market levels pursuing different business models to sponsor their proprietary technologies and to maintain market share for their products and services. Interoperability of products is a crucial factor for market success and firms evermore have to coordinate and set standards...

The latest chapter in the annals of standardization skullduggery–or, so far, alleged standardization skullduggery– involves the Universal Mobile Telephone System (UMTS) standard. Broadcom Corp., a manufacturer of semiconductor ICs (chipsets) for communications applications, has sued Qualcomm Inc., another chipset manufacturer and the owner of patents essential to complying with the standard. Br...
